INVASION: Texas Attorney General Paxton (Part 4)
BORDER CRISIS exposes destruction agenda for the United States, as the Texas General responds
written by Patriots in Texas.
In this series on the INVASION of the United States we are documenting the failed border protection as required by the United States Constitution. Texas Attorney General Ken Paxton has become like a mythical lone wolf on the lawfare battlefield of the modern age. Taking on the role of town sheriff, in what has become a wild west land of lawlessness in Texas.
AG Paxton has received an intense amount of news coverage over recent impeachment accusations. If you accepted what the news said you might assume he’s just another corrupt politician, we have lots of those. But considering the large number of legal actions he’s initiated, the news narrative falls far short of the whole story. It was members of his own party who were the biggest advocates of what became a failed attempt to remove him from office. Yet Texas voters in 2022 put him back in office to continue his work. What’s the truth? Is Ken Paxton the hero or villain? Or are the impeachment managers to be believed and his election victories that endorse his work holding corporate and government overreach accountable, reveal he’s a sort of legal vigilante? Let’s investigate and decide for ourselves.
To start, let’s look back to the Clinton impeachment of 1998. The Democrats rallied behind him. Republicans supported Governor Rick Perry after indictments were issued for Abuse of Power. But with Paxton… we see a divided party. What’s going on?
When the world is a stage and the full truth has yet to be exposed, it makes an audience member contemplate the authenticity of events unfolding.
In Texas, we have what appears to be a song and dance routine between state and local officials with the federal government. Discerning the purported rivalry can be challenging for even the most attuned spectator. Observe carefully, though, because it is unconstitutional for anyone to be aiding and abetting an invasion.
Article I, Section 10, Paragraph 3: No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.
Border Conflict
The Biden Administration refused to let Texas officials tour the migrant camps.1 Texas officials are granted permission and discover atrocious conditions migrants are dealing with.2, 3 The conditions are so bad that even members of Biden’s own party are calling out the President for the atrocities.4
Local border-city officials are objecting to the Governor Greg Abbott’s inaction to what they proclaim is an “act of war.”5 So, on June 10, 2021, Gov. Greg Abbott announced the formation of a Task Force on Border and Homeland Security, in which Paxton will team up with the taskforce for strategy.6
Paxton filed a motion to force the Biden Administration to comply with Title 42. He had a victory when the U.S. District Court for the Southern District of Texas granted Texas’ motion for summary judgment and struck down the Obama’s DACA program. Judge Hanen also permanently enjoined the federal government from approving new DACA applications or granting DACA status to additional illegal aliens. Paxton celebrated:
“The district court sided with the great state of Texas, granting us some much-needed relief – a preliminary injunction,” Attorney General Ken Paxton said. “The court saw the blatant irresponsibility from the Biden Administration that has caused tremendous harm to the safety of all Texans. It’s time for the federal government to wake up and address the chaos that they caused – and in the meanwhile, we will fight tooth and nail to protect Texans from their carelessness.”
The Biden Administration began bussing and flying illegal immigrants into cities, so Governor Abbott signed an Executive Order to ban bussing.7, 8 Since the Biden Administration reversed the production of the border wall, Customs and Border Protection began canceling contracts related to the wall.9
The state of Texas, as a sovereign political entity, has the inherent authority to enforce its own borders and protect its citizens. Article IV, Section 4 of the U.S. Constitution guarantees that the federal government shall protect each state of the Union against invasion. It is not voluntary. It is a constitutional mandate created to guarantee the protection of all the states in the Union. Anticipating that the federal government at some point may not follow the constitutional mandate, the framers added something else, another guarantee for the states. Under Article I, Section 10, Clause 3, the states reserved their sovereign authority to act in the protection of their citizens when threatened by “invasion or imminent harm.”
It is only logical to conclude that the authors of the U.S. Constitution included this expressed reservation of state sovereignty for times when the federal government is not able, or willing, to uphold its guarantee of protection under Article IV, Section 4. In other words, this reserved authority functions the same way as a “break the glass in case of emergency” scenario.
By the end of August, Paxton joined a multistate coalition demanding the continued criminalization of illegal reentry and filed an Amicus Brief because the Biden Administration stopped detaining illegal aliens convicted of crimes related to drugs or moral turpitude – despite the law requiring it – forcing Texas to sue.
The Texas Governor closed points of entry along the border, and the Texas National Guard was begging for assistance from their volunteer members.10 The state was preparing for a rush on the border that would more than likely surpass any others experienced in the U.S.11
A House Republican, tipped off by a San Diego whistleblower, has seen documents from nonprofits in California which outline secret operations to reposition illegal border crossing migrants into the United States.
The nonprofits are providing illegals with documents and means to navigate their migration into the United States, Rep. Lance Gooden, R-Texas, told Fox News.
Paxton filed a motion for the enforcement of Migrant Protection Protocols against the Biden Administration and started releasing a video series called The Borderlands, claiming the Biden Administration's failed immigration policies have put those at the border in danger and their property at risk.12 During this series, we hear from the ranchers and law enforcement living along the border that fight the issues stemming from these policies day in and day out. In addition, the Office of Attorney General has added educational videos on human trafficking as well as a webinar series.
The Attorney General traveled to Del Rio and Brackettville to see firsthand the devastating effects of the Biden Administration’s failed immigration policies. He met with Texas Department of Public Safety, Texas National Guard, Customs and Border Patrol, Kinney County officials, and the Texas Border Sub-Regional Planning Committee to listen to their concerns as they deal with illegal aliens pouring into our country on a daily basis.
On October 21, 2021, Paxton sued the Biden Administration, demanding the continuation of border wall construction. Texas looks for ways to make the project happen independently of the federal government.13 SCOTUS compelled the Biden Administration to reinstate the Trump-era “Remain in Mexico” program, previously known as the Migrant Protection Protocols (MPP). In a lawsuit opened by the State of Texas, a federal district court ordered the Biden Administration to reinstate the program, which the U.S. Supreme Court affirmed. But even still, Texas used their imagination.
Governor Greg Abbott posted on twitter:
Texas National Guard & Texas Dept. of Public Safety continue to create a steel wall along the southern border.
Large shipping containers, resources, & personnel are being used to protect communities & property owners.
Texas is securing the border.
November 17, 2021
Paxton joined a multi-state letter with other attorneys general objecting to the American Law Institute (ALI) proposed amendments to the Model Penal Code (MPC). If adopted, the amendments would negatively affect human trafficking victims by reducing legal protections and reducing criminal liability for human traffickers. The amendments would also increase the risk that those purchasing sex or profiting from it could escape responsibility for their role in sex trafficking. U.S. Border Patrol agents registered 1,957,133 encounters with migrants stopped at the border under the Biden administration between February 2021 and December 2021.14
In a comprehensive 117-page opinion, United States Fifth Circuit Judge Andrew Oldham affirmed the trial court’s decision, and the “Remain in Mexico” (MPP) program has been restored through a permanent injunction. Joined by Arkansas, Alaska, Florida, Indiana, Missouri, Montana, and Oklahoma, Paxton launched his 9th border-crisis lawsuit against Biden on January 28, 2022, the 20th lawsuit since Biden took office. Furthermore, he demanded the resignation of DHS Secretary, Alejandro Mayorkas.
On April 8, 2022, “Attorney General Paxton announced a settlement win in his lawsuit against the City of San Antonio, the San Antonio City Manager, and the City’s Chief of Police, brought to address their violations of Senate Bill 4 (SB4), Texas’s Anti-Sanctuary City law. The settlement includes a $300,000 payment by the City of San Antonio, changes to the City’s policing practices and policies to comply with SB4’s requirements, and a further agreement to retain the settlement in Travis County District Court so that General Paxton can monitor the City’s compliance on a going-forward basis. The win against San Antonio adds to the continuous efforts by Attorney General Paxton to address the current border situation, which includes numerous successes in holding the Biden Administration accountable in court for its contributions to the ongoing crisis.” However, this victory for Paxton has not deterred the city from continuing to violate the law.
AG Paxton instigated the 10th border crisis lawsuit against the Biden Administration on April 22, 2022, asserting:
“The Biden Administration has made one disastrous border decision after another, and I’ve sued him at every turn,” said Attorney General Paxton. “But his new plan to rescind Title 42 is the most consequential yet. Without Title 42, hundreds of thousands more illegal aliens will flood Texas every month – even more than have been pouring over in the past year. His goal is simple: get as many illegals in this country as fast as possible without any concern for the potential criminal or terrorist background of those crossing the border. This is allowing the cartels to maximize their profits and their effectiveness. Biden cannot make such sweeping decisions without going through the process required by federal law. He didn’t, so I’m suing. I’ll hold him accountable and do all I can to protect Texans.”
Changing The Invasion Strategy
Biden lowered the bar for asylum seekers, so Paxton sued again. Rather than send the illegal immigrants back over the border, Governor Abbott changed gears and began shipping them to the interior parts of the United States.15 This ruse is being performed under the guise that, since Biden brought illegals to Texas, he’ll get back at them by shipping them to their cities.16 How many people actually believe that this is retaliation instead of usurpation of the U.S. Constitution?17 The Governor of Florida took issue with Abbott’s policy;18 however, he eventually got on board.19
The U.S. Customs and Border Patrol released their May 2022 “Monthly Operational Update”, detailing their encounters and how they are responding to the increased caseload. Furthermore, The Human Trafficking Institute released an article claiming, “Human trafficking, the “crime of using force, fraud, or coercion to compel an individual to work or to engage in a commercial sex act,”20 is the world’s second-largest criminal industry, generating an estimated $150 billion annually.21 The U.S. Department of State estimates between 14,500 and 17,500 victims are trafficked within the United States each year.22 An estimated 72% of these victims are immigrants.23 Immigrants are often drawn to the U.S. with the promise of a good job and the opportunity to send money to family back home and can be particularly vulnerable to trafficking. Among the federal human trafficking cases filed in 2021, adult victim vulnerabilities identified included undocumented immigration status (49%), limited English proficiency (47%), and financial debt (70%).24 Even with a strong link between immigration and human trafficking, the two issues are often compartmentalized to allow bi-partisan human trafficking legislation to pass without being burdened by hotly contested immigration policy. However, this practice greatly hinders anti-trafficking efforts by divorcing two closely interrelated issues.”
SCOTUS issued their opinion on the Remain-in-Mexico program, and Paxton expressed his disappointment:
“Today’s decision by the U.S. Supreme Court is an unfortunate one, and I believe it was wrongly decided. Over a year ago, Texas and Missouri sued the Biden Administration for illegally abandoning MPP. I won in district court and then won again on appeal. The Administration dragged its feet and refused to implement this effective program in good faith, allowing hundreds of thousands of illegals to pour over the border month after month. Today’s decision makes the border crisis worse. But it’s not the end. I’ll keep pressing forward and focus on securing the border and keeping our communities safe in the dozen other immigration suits I’m litigating in court.”
However, on July 22, 2022, SCOTUS handed the Attorney General another victory. “The Biden Administration just can’t help itself from breaking the law—especially immigration law,” said Attorney General Paxton. “They have begged every court up to the Supreme Court to let them off the hook, and every time the court says ‘no.’ Yesterday the Supreme Court made clear that, while we prepare for oral argument this winter, the Biden Administration must detain illegal aliens with criminal convictions. It’s the right legal decision, and it’s what’s best for Texas and our nation.”25
County Judges near the southern border are planning to declare emergency due to the challenges they are facing with illegal immigration. Goliad County Sheriff Roy Boyd has been aggressively pursuing cartel-related trafficking activity coming from the border. “From the time of Texas independence from Mexico until today, Texas has played a key part in American growth and exceptionalism,” Boyd told The Center Square. “The rugged individualist mentality of Texans is what spurs us to take matters into our own hands instead of huddling in the protective shadow of the government waiting for answers and permission that may never come.26
“This spirit of independence, along with our sense of duty to our fellow man, is what drives counties such as ours to take bold steps at times like this,” he added. “We are compelled to act within the constitutional limits set by our forefathers in order to preserve the way of life they envisioned and we enjoy.”
“We act today, in the face of government complicity, in order to try to ensure that our children and grandchildren are free citizens in the decades to come,” he said. “The Texans at San Jacinto rallied at the cry of ‘Remember Goliad. Remember the Alamo.’ And they were victorious. If we win this war against our freedoms, we will have to add, ‘Remember Kinney County,’ because they have stepped into the void of leadership and stood up for Texas and America when few others were willing.”
Betrayal Within
Meanwhile, the Governor does more busywork as reported by Bill Melugin on Twitter:
BREAKING: Texas Governor Greg Abbott has issued an executive order authorizing Texas DPS & Texas National Guard to apprehend illegal immigrants and return them to the border. His office tells me they will be returned to ports of entry on the U.S. side, *NOT* to Mexico.
July 7, 2022
While Abbott plays games with the rest of the country,27 he should be declaring an invasion because that’s exactly what it is. The Federal Government is failing to follow Article 4, Section IV of the U.S. Constitution, protecting states from invasion. Instead, in an attempt to placate the public, his make-shift maneuver is really a half-hearted attempt to appear as though he is standing up for something – when he’s not. Why put on all the showboating and grandstanding during his time in office? Afterall Greg Abbott can be found on the World Economic Forum website. Which says:
BBA in Finance, University of Texas, Austin; degree in Law, Vanderbilt University Law School. Formerly: State District Judge, Harris County; Justice on the Texas Supreme Court; longest serving Attorney General of Texas; collected more than $31 billion in child support for Texas children; in 2014, the office was recognized as the nation’s best child support program by the National Child Support Enforcement Association. Currently, 48th Governor of the State of Texas; vision is to build a better future for Texas, a vision focused on creating jobs and economic opportunity, improving education, building transportation infrastructure and securing Texas’ border in the face of federal government inaction; has established a Cyber Crimes Unit to arrest criminals who use the internet to prey upon children, a Fugitive Unit to arrest convicted sex offenders who violate their parole, and an expanded Medicaid Fraud Control Unit to crack down on elder abuse and waste of taxpayer dollars. Avid sportsman and hunter.
Could it be that Governor Abbott holds allegiance to the New World Order rather than the people of Texas? It certainly appears that the American government has been infiltrated at all levels with officials who do not serve the interests of the people. And what about all the illegal immigrants entering the county? The Uvalde Mayor claims, “the Del Rio border sector near Uvalde has recorded illegal migrants hailing from 67 nations.”28 Many of the immigrants are adult, miliary-age men.29
Governor Abbott went on Fox News in early December of 2023 to joyfully announce a NEW law.
I'll be signing a law in Texas that will make it illegal for people to enter the state of Texas from another country illegally, and authorizing every peace officer to arrest those people entering our country illegally.
The questions we should all ask, why didn’t they uphold the laws on the books? Why did he wait this long?
While everything appears to be a show, one can only speculate as to what is happening under the guise of immigration at our southern border. It is important to note that the United Nations has more than 97,000 uniformed personnel coming from over 120 countries. They are first and foremost members of their own national armies and are then seconded to work under the command and control of the United Nations.30 None of the police units or military troops for the UN are American.31
US Constitution Challenge
DACA pronounced Unconstitutional. On October 5, 2022, the Fifth Circuit Court of Appeals granted Paxton another win for his battle against DACA. In its ruling, the Appellate court affirmed a July 2021 decision by a Texas federal judge, US District Judge Andrew Hanen, who declared DACA illegal. Jonathan Turley noted, “Writing for a unanimous three-judge panel of the Fifth Circuit (with U.S. Circuit Judges James Ho and Kurt Engelhardt), Chief Judge Priscilla Richman found that President Obama did indeed circumvent Congress and evaded the limits imposed in the Immigration and Nationality Act (INA) when it enacted DACA in 201232…For years, I have written that I considered President Barack Obama’s action to create Deferred Action for Childhood Arrivals (DACA) to be unlawful. The move was part of an open effort to circumvent Congress when it failed to yield to the demands of President Obama and discarded with obligations under the Administrative Procedure Act (APA).”33 Paxton34 responded:
“Only Congress has the ability to write our nation’s immigration laws, and I applaud the Fifth Circuit for affirming DACA as the unlawful executive action that it is,” said Attorney General Paxton. “The chaos at our southern border is bringing violence to our communities and costing Texans hundreds of millions of dollars. President Obama’s refusal to enforce immigration law was an offensive dereliction of duty then, just as President Biden’s refusal to help secure our borders is now.”
In recognizing Texas’s legal standing to bring the case, the court highlighted just how steep the costs of DACA are to the people of Texas: “Texas has satisfied the first standing requirement by demonstrating injury in fact…. Texas Presented evidence that it spends millions of dollars providing these services to unauthorized aliens each year…. An expert for defendants estimated that DACA recipients overall impose a cost of more than $250,000,000 on Texas per year and another $533,000,000 annually in costs to local Texas communities.”
Freedom Forward
Is Ken Paxton working in tandem with the scriptwriters on this global stage, or is he truly the lone actor, off-script and improvising to prevent illegal actions from his Attorney General Position?
In considering the decades long global agenda for a North American Union uniting the US, Mexico and Canada that is achieved by the previous trade policies of NAFTA (North Atlantic Free Trade Agreement) and eliminating border security. President Donald Trump’s first term in office disrupted the Democratic New World Order by replacing NAFTA with the USMCA (United States–Mexico–Canada Agreement) in service of the the interests of the US citizens. And his relentless work to Build The Wall that democrats used lawfare to disrupt, but failed to prevent. Ken Paxton has become an enemy of these same groups for his actions to uphold Texas state and US national border laws.
The battle is heating up in Texas apart of the ongoing conflict for the future of the United States. Will the nation continue towards its initial vision of a prosperous republic of self government by We The People? Or will the decades long agenda to destroy the USA and remake it into another failed socialist state. There is quite the climax in the making for the unfolding story of the United States…
