Since October 2022, the Texas Attorney General has slapped the Biden Administration with a barrage of lawsuits to defend Texans from the overreaching federal government, ranging from contracts with Non-Governmental Organizations to violations against the Constitution, which were intended to protect the people from a tyrannical government. Does Paxton have the winning hand in this game of lawfare, though?
After Paxton’s major success in the Fifth Circuit of Appeals declaring DACA unconstitutional, U.S. District Judge Andrew Hanen will retake the case under his advisement. He previously opined that the Department of Homeland Security had implemented DACA in violation of the Administrative Procedure Act (APA). Fox News explained, "Biden specifically blamed 'MAGA-Republican officials' for the court’s decision as several Republican-led states sued the federal government over the DACA program. Governors allege the program negatively impacts their local economies as they have to foot the bill for DACA recipients’ education and healthcare."
The costs for those states actually run into the hundreds of millions of dollars annually to subsidize the lifestyles of illegal aliens that Obama created the program to protect.1 In response, the Biden administration developed a new DACA rule and published it on the Federal Register to satisfy the public notice-and-comment process. The new rule is scheduled to become active on October 31, 2022.2
Department of Homeland Security (“DHS”) Secretary Alejandro Mayorkas posted to Twitter:
I am deeply disappointed by today’s #DACA ruling and the ongoing uncertainty it creates for families and communities across the country.
We are currently reviewing the court’s decision and will work with The Justice Department on an appropriate legal response.
As a result of the stay that remains in place, no one who currently has DACA will lose their protection from removal or work authorization
Meanwhile, Texas Governor Abbott bragged in a press release, “Since the launch of Operation Lone Star, the multi-agency effort has led to 304,700 migrant apprehensions and more than 19,800 criminal arrests, with more than 17,400 felony charges reported. Texas has also bused over 8,000 migrants to our nation's capital since April and over 2,500 migrants to New York City since August 5. More than 600 migrants from Texas have arrived in Chicago since late August. The busing mission is providing much-needed relief to our overwhelmed border communities.” Abbott took a moment to weigh in on the border.3
Texas Governor Abbott bragged in a September 2022 press release:
“Since the launch of Operation Lone Star, the multi-agency effort has led to 304,700 migrant apprehensions and more than 19,800 criminal arrests, with more than 17,400 felony charges reported. Texas has also bused over 8,000 migrants to our nation's capital since April and over 2,500 migrants to New York City since August 5. More than 600 migrants from Texas have arrived in Chicago since late August. The busing mission is providing much-needed relief to our overwhelmed border communities.”
2 months later Abbott took a moment to weigh in on the border3:
I invoked the Invasion Clauses of the U.S. & Texas Constitutions to fully authorize Texas to take unprecedented measures to defend our state against an invasion.
I’m using that constitutional authority, & other authorization & Executive Orders to keep our state & country safe:
• Deploy the National guard to safeguard our border & to repel & turn back immigrants trying to cross the border illegally;
• Deploy the Texas Department of Public Safety (DPS) to arrest & return to the border immigrants who crossed illegally & deploy DPS to arrest illegal immigrants for criminal activity;
• Build a border wall in multiple counties on the border;
• Deploy gun boats to secure the border;
• Designate Mexican drug cartels as foreign terrorist organizations;
• Enter into a compact with other states to secure the border;
• Enter into agreements with foreign powers to enhance border security; &
• Provide resources for border counties to increase their efforts to respond to the border invasion.
In Eagle Pass, Texas Jorge Ventura Media filmed 2,000 of the 2.4 million apprehended migrants in 2023.
Abbott shared some laughs with Biden upon his visit to the border: handing him a letter for a photo-opportunity. “Your visit to our southern border with Mexico today is $20 billion too little and two years too late. Moreover, your visit avoids the sites where mass illegal immigration occurs and sidesteps the thousands of angry Texas property owners whose lives have been destroyed by your border policies. Even the city you visit has been sanitized of the migrant camps which had overrun downtown El Paso4 because your Administration wants to shield you from the chaos that Texans experience on a daily basis. This chaos is the direct result of your failure to enforce the immigration laws that Congress enacted,” Abbott wrote in his letter to Joe Biden.5
The distaste for the policies emanating from the Executive branch in Texas continue to grow. Archbishop Gustavo September 18, 2022 raises concern:
To use migrants and refugees as pawns offends God, destroys society and shows how low individuals can be for personal gains. These tactics -buses- promote human trafficking. We pray for conversion of heart. God protect our Sisters and brothers in need.
Necessary Remedies
After Paxton secured his victory for Attorney General during the 2022 election, he announced he, “is launching an investigation of Texas Bar Foundation fund recipients to determine whether funds contributed to it are being used to support the border invasion.” This expands upon Paxton’s investigation into the Foundation. The three targets of the Agency’s Requests to Examine (RTEs) are recipients of Texas Bar Foundation funds: American Gateways, Tahirih Justice Center, and Equal Justice Center.
“Biden and his allies have caused an invasion at the border and a crisis in the homeland. Not only has this Administration abdicated its duty to secure the border, but it has also actively encouraged an illegal invasion into the United States,” said Attorney General Paxton. “What’s more, it seems some Texas groups may be facilitating the invasion. I won’t tolerate it. I will stay firm in my duty and responsibility to serve and protect Texans from the fallout of these irresponsible parties,” said Attorney General Paxton.
The Biden Administration began attempting to implement its own DACA rule. Therefore, Paxton filed suit in December 2022.
“The Biden Administration is once again attempting to ignore the rule of law by abusing executive authority to implement its own version of mass amnesty,” said Attorney General Paxton. “But the fundamental issues with Obama’s DACA program are present in the Biden rule, and this complaint will move us one step closer to ending DACA in its totality.”
On January 5, 2023, Attorney General Paxton filed another lawsuit to stop the Biden Administration from ignoring a federal immigration law, known as the public-charge rule, that prevents illegal aliens from residing in the country if they are likely to rely on taxpayer-funded programs. He also petitioned the United States Supreme Court for permission to defend the prior rule that the Biden Administration refuses to defend.
And another one...Paxton leads a multistate coalition to sue the Biden Administration over a new Department of Homeland Security (“DHS”) program that unlawfully creates a pathway to citizenship for hundreds of thousands of aliens on January 24, 2023.
“Every state in America, especially border states like Texas, is being crushed by the impacts of illegal immigration,” said Attorney General Paxton. “The Biden open borders agenda has created a humanitarian crisis that is increasing crime and violence in our streets, overwhelming local communities, and worsening the opioid crisis. This unlawful amnesty program, which will invite hundreds of thousands of aliens into the U.S. every year, will only make this immigration crisis drastically worse.”
The Texas Attorney General joined a Virginia-led multistate coalition in sending a letter to Joe Biden and Antony Blinken requesting that violent Mexican cartels be designated as Foreign Terrorist Organizations (FTOs). He also joined a Montana-led Amicus brief, which states, “More than ever, illegal immigration imposes tremendous economic, social, and fiscal burdens on the states. The decision below, if left undisturbed, will impede the enforcement of criminal immigration laws nationwide, leading to significant adverse consequences for the Amici States.”
In Paxton’s Personal Trials. On February 9, 2023, it was reported that Paxton agreed to a $3.3 million settlement with the aides that sued him for retaliation for reporting abuse of office to the FBI, and apparently, Paxton asks the House Appropriations subcommittee for $3.3 million to fund the whistleblower settlement. The FBI transferred the corruption case over to the Department of Justice: Public Integrity Unit.6 In an interesting turn of events, the Austin real estate investor fundamental to the accusations against Paxton for illegal conduct, Nate Paul, is found in contempt of court. He is ordered to serve time in jail and pay a fine. The whistleblowers filed a motion asking the Texas Supreme Court to agree to allow their lawsuit to proceed. They claim that Paxton's office will not agree because the Texas Legislature would have to approve the settlement during the 2023 legislative session.
Yet still, the Attorney General continues to fight back against the lawlessness occurring in this country. Biden’s open-borders agenda created a new federal rule that would embolden more illegal aliens to enter the country. Paxton joined an Indiana-led letter sent to Department of Homeland Security (“DHS”) Secretary Alejandro Mayorkas and Attorney General Merrick Garland, which criticized the rule that would worsen the crisis-level border crossings and related costs imposed on the American people as a result of the Biden’s immigration policies.
The Biden Administration’s effort to maximize illegal immigration to the United States will decimate Texas with the costs, crime, and disorder from yet another surge of unvetted foreigners entering our country, as Title 42 expires on May 11, 2023. Paxton filed a motion for a temporary restraining order to request that the courts stop Biden from enacting the unlawful policy that releases illegal immigrants into communities across America as record numbers of immigrants surge to the United States-Mexico border. On May 10, Paxton issued the following statement:
“The brutal reality of Biden’s immigration agenda should shock the conscience of every American. His policies allow monstrous gang members, terrorists, human traffickers, drug dealers, and violent criminals into our country and demonstrate that the President is willing to sacrifice American lives for his open-borders agenda. Furthermore, our public services, including overburdened schools, hospitals, and law enforcement, are saddled by the federal government with unsustainable costs as billions of dollars are spent supporting illegal aliens residing in Texas.
Never in our history has a president worked so flagrantly against the interests of our nation and the safety of our citizens. Title 42 is set to expire on May 11, yet Biden has refused to implement the proven ‘Remain in Mexico’ policy or other sensible methods of deterring illegal immigration. Instead, he has introduced and continued destructive policies with the full expectation that the chaos will worsen. This includes his unlawful ‘parole’ program that pre-approves huge numbers of aliens to enter the country, his ‘prioritization’ guidance that directed ICE to shield criminal aliens from deportation, his new overseas processing facilities to fast-track so-called ‘asylum seekers’ to fly directly into the United States, his airplane tickets and other services to aliens while our own citizens struggle financially, and his complicity in the trafficking of minors forced to toil as indentured servants in dangerous jobs.
While no amount of suffering appears to dissuade Biden from his open-borders agenda, his routine violations of the United States Constitution open him up to accountability through the courts. I will continue to use every resource available to end his unconstitutional assault on our borders and sovereignty.”
But then, a foul lushery was afoot at the 2023 Legislative session. Citizen Free Press posted on the 20th of May 2023:
Texas House Speaker Dade Phelan last night. Is he having a stroke or just drunk.
Impeachment for Power
The Texas House's Committee on General Investigating notified Paxton's office with a letter stating that there is a House investigation into Paxton because he asked for public money to settle with the whistleblowers and directed Paxton's office to preserve records. Paxton's office tweeted the infraction and reported to the chairman of the Committee on General Investigating, Andrew Murr, calling for an investigation into Phelan "for violation of House rules, state law, and for conduct unbecoming his position." Phelan's office describes Paxton’s tweet as "little more than a last-ditch effort to save face" over the investigation into the whistleblower allegations.7
A statement published to Twitter on May 20, 2023 from Attorney General Ken Paxton:
After much consideration, it is with profound disappointment that I call on Speaker Dade Phelan to resign at the end of this legislative session. Texans were dismayed to witness his performance presiding over the Texas House in a state of apparent debilitating intoxication. His conduct has negatively impacted the legislative process and constitutes a failure to live up to his duty to the public. Texans were relying on the House to pass critical conservative priorities including protecting the integrity of our elections and preventing Chinese spies from controlling Texas land. His failures as Speaker have created a credibility crisis for all Republican candidates and for our entire Party. While I hope Speaker Phelan will get the help he needs, he has proven himself unworthy of Texans’ trust and incapable of leading the Texas House.
Even with the game evolving, the Attorney General filed another lawsuit on May 23, against the Biden Administration to challenge a rule that encourages illegal immigrants to use the CBP One mobile application to schedule their unlawful crossing into the United States.
May 24, 2023, The House Committee on General Investigating began its hearing into Paxton's $3.3 million whistleblower settlement. Four invited witnesses were scheduled to provide testimony. The hearing has no legal bearing.8
Patrick Svitek, Primary political correspondent at Texas Tribune posted:
On with Mark Davis, Ken Paxton is asked about the House investigation into him. “I don’t know,” Paxton says. “This is unprecedented for what they’re doing. I have no idea why they’ve chosen to do this.”
The Texas House votes to impeach Paxton: 121-23 in favor of impeachment, with two members voting present and three absences.9 Paxton awaited his Senate trial set for September 5, 2023 and has been suspended. He says he will not testify.10 John Scott (former Secretary of State) has been appointed to replace him in the meantime.11 The decision to impeach Paxton has prompted Republican chairs across the state to present resolutions and consider sanctions for the representatives.12
Jason Buster posted to Truth Social:
For all the Texans on here, and those who are following the ridiculous Paxton debacle, were y’all aware John Scott is a defendant in a Federal lawsuit alleging Federal and State Election Code violations as Deputy Secretary of State for Texas? How can he serve as interim Texas AG with these charges against him?
Governor Abbott Appoints John Scott As Interim Attorney General of Texas.
AUSTIN – Governor Greg Abbott today appointed John Scott as the short-term interim Attorney General of Texas, under Article 15, Section 5 of the Texas Constitution
“John Scott has the background and experience needed to step in as a short term interim Attorney General during the time the Attorney General has been suspended from duty,” said Governor Abbott. “He served under me in the Teas Attorney General’s Office and knows how the Office of the Attorney General operates. Scott was the Deputy Attorney General for Civil Litigation and has handled cases at all levels of the justice system. His decades of experience and expertise in litigation will help guide him while serving as the state’s top law enforcement officer. I appoint John Scott for this role based on the Texas Constitution to serve for a temporary period during the Texas Senate’s resolution of the impeachment proceedings.”
JOHN SCOTT of Fort Worth is an attorney with over 34 years of experience. Scott most recently served as Texas Secretary of State for Governor Abbott. Previously, he served as Texas Deputy Attorney General for Civil Litigation for then-Attorney General Greg Abbott, where he aided then-Attorney General Abbott’s efforts to hold the Obama Administration accountable and sue President Obama more than any other state Attorney General. Scott oversaw all civil litigation, including over 22,000 lawsuits involving Texas. Subsequently, Scott was appointed the first Chief Operating Officer of the Health and Human Services Commission. He oversaw the successful overhaul of the agency, its 56,000 employees, and its over $50 billion biannual budget. After returning to private practice, Governor Abbott appointed Scott as the Chair of the Board for the Department of Information Resources (DIR). At DIR, Scott developed the strategic plan for technology and security at Texas executive branch agencies and boards.
In addition to Tarrant County, the Collin County GOP also published a resolution condemning the impeachment process.
Whereas Texas Attorney General Kenneth Paxton was impeached by the Texas House of Representatives on May 27, 2023, after a report was issued by the House General Investigating Committee (GIC) containing twenty articles of impeachment. The GIC submission, which consisted solely of a transcript of the GIC hearing, was considered by the House for approximately 48 hours before the impeachment vote was called and taken, no testimony was taken in the House, and General Paxton was not allowed to speak to the House or offer any rebuttal evidence or testimony although he offered to do so and was refused; and
Whereas the impeachment of General Paxton failed to comply with applicable law and historical precedent, to wit:
1. The general Investigating Committee admitted that none of the witnesses who provided information to the committee were placed under oath before giving their statements as required by Texas Government Code § 301.022;
2. The General Investigating Committee included in their consideration, and included in the articles of impeachment alleged conduct that took place before the date when General Paxton was elected and took office in his current term, and such conduct may not serve to support removal of a state officer in accordance with Texas Government Code § 665.081, and thus should not have been part of the impeachment process in accordance with Texas Supreme Court precedent found in Reeves v. State, 267 S.W. 666 (Tex. 1924);
3. The General Investigative Committee and the House of Representatives failed to give General Paxton the opportunity to present evidence in his defense, including the right to cross-examine witnesses against him in the spirit of the U.S. Constitution Amendments V and VI and the precedent established by the Texas House of Representatives in the 1975-76 Carrillo impeachment proceeding; and
Whereas Due Process and the Rule of Law are the very foundation of our republic and necessary to the proper functioning of a free society without adherence to which we become nothing more than a banana republic; and
Whereas notice and an opportunity to be heard and to defend oneself are the hallmarks of Due Process and it is the sincere desire of the Republican Party of Texas that the State of Texas and its legislative bodies adhere to the Rule of Law and not become a banana republic.
NOW THEREFORE BE IT RESOLVED that the Collin County Republican Party CONDEMNS the process by which the Texas House of Representatives impeached General Paxton as unprecedented and an offense to Dupe Process and the Rule of Law, and hereby IMPLORES Texas Lt. Governor Dan Patrick and members of the Texas Senate to uphold Due Process, fairness, precedent, and the Rule of Law by immediately returning the impeachment articles to the House of Representatives and conduct no further proceedings in the Texas Senate unless and until the House of Representatives fully satisfies due process, complies with applicable Texas law, and adheres to precedent regarding the Constitutional and statutory impeachment processes, and that Ken Paxton be immediately resume his duties as duly-elected Attorney General.
At the very least, there seems to be some shenanigans going on…
Jonathan on Twitter commented:
It appears the CIA homies are going hard after Texas AG Ken Paxton to remove him from office.
Ever since he helped Texas make big moves for election integrity (ERIC) and called out Dade Phelan’s drunk ass, they’ve come at him guns blazing.
No worries, Pax. We got your back.
John Phelan is the Co-Founder and Chairman Emeritus of MSD Capital, LP. Prior to forming MSD Capital, he was a Principal for seven years at ESL Partners, a Greenwich, Connecticut-based investment firm.
On September 16, 2023 the Texas Senate acquitted Ken Paxton was acquitted of his impeachment charges. He then filed a criminal complaint against the impeachment managers as reported by the Dallas Morning News:
The criminal complaints Texas Attorney General Ken Paxton plans to file against the legislators who spearheaded his impeachment are “baseless” and should be dismissed, the Texas House’s lawyer told local prosecutors in letters The Dallas Morning News obtained.
Margo Cardwell, general counsel to the House, sent letters to at least two district attorneys urging them not to take action on complaints Paxton files alleging lawmakers improperly published his address when posting impeachment-related documents online last week.
Upon being reinstated as Texas Attorney General on September 22, 2023, Paxton initiated a list of actions. Most notably, he sued the Biden administration over destruction of Texas border barrier, issues enforcement guidance for state laws prohibiting public contracts with companies unlawfully maintaining “ESG” policies, and defeated Googles efforts to avoid the transfer of landmark antitrust case back to Texas.
During the end of 2023 there was a string of swatting incidents against one side of the political aisle. And Ken Paxton’s home was targeted on January 1, 2024. Fortunately he wasn’t home.
Invasion Agenda
At the turn of the new year in 2024 a tactic of the deep state strategy was revealed by Tore Maras on the Tore Says Show. In her January 5 broadcast at the 1 hour and 47th minute mark she presented overlooked US Constitutional law that reduces a state’s representation in congress if voters are denied their right to vote. This doesn’t initially seem like a problem until you consider the millions of illegals who have been invited to invade the US border. Then flown and bussed at tax payer expenses to various states.
TORE MARAS - understand the 14th Amendment and why it was created. Because all of us can get together and sue Kamel Harris and Maxine Waters for partaking in an insurrection that was never addressed. And let's not forget, didn't President Trump send them help when the riots were happening? Yes, he did. But during the alleged insurrection, the only time of President can actually send help is if they ask. But they didn't ask, because they planned it.
We must read it for ourselves:
US Constitution. 14th Amendment. Section 2.
Representatives shall be apportioned among the several states according to their respective numbers, counting the whole number of persons in each state, excluding Indians not taxed. But when the right to vote at any election for the choice of electors for President and Vice President of the United States, Representatives in Congress, the executive and judicial officers of a state, or the members of the legislature thereof, is denied to any of the male inhabitants of such state, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such state.
After playing a clip from Professor Eric Foner on the 14th Amendment on her show, Tore Maras challenged us to consider what the future will be like if illegal migrants are granted the right to vote. After reading what is actually written section 2 of the 14th Amendment says. She then shared her critical video uploaded to TikTok from December 30, 2023 (we back up here in case it’s deleted as often happens with her content).
On her January 5th show she reminded us:
President Trump has got this. What did he instruct the public to do? Fix your elections. Because right now the way we're heading is straight into their trap. And we are literally marching to their drum. With our amazing influencers pushing so much. Rather than being laser-focused.
The Unfolding Battle
The spark of the conflict in Texas shows us what their plans are for the whole nation. The attacks on President Trump during an election are unprecedented. Impeachment charges on Texas’ AG in the midst of the invasion crisis are unprecedented. What is the cause of so many attacks?
With so many independent voices standing up for Ken Paxton during his impeachment, what causes so many to view him like a lone wolf fighting against the corruption? What are the grounds for prominent influencers to claim he is THE attorney FOR the people – America’s Attorney General?
“But whatever may be our situation, whether firmly united under one national government, or split into a number of confederacies, certain it is, that foreign nations will know and view it exactly as it is; and they will act toward us accordingly. If they see that our national government is efficient and well administered, our trade prudently regulated, our militia properly organized and disciplined, our resources and finances discreetly managed, our credit re-established, our people free, contented, and united, they will be much more disposed to cultivate our friendship than provoke our resentment. If, on the other hand, they find us either destitute of an effectual government (each State doing right or wrong, as to its rulers may seem convenient), or split into three or four independent and probably discordant republics or confederacies, one inclining to Britain, another to France, and a third to Spain, and perhaps played off against each other by the three, what a poor, pitiful figure will America make in their eyes! How liable would she become not only to their contempt but to their outrage, and how soon would dear-bought experience proclaim that when a people or family so divide, it never fails to be against themselves.” Publius (John Jay) The Federalist Papers # 4.
Article I, Section 8, Paragraph 15: The Congress shall have the Power (to) provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;
Texans witnessed acquittal in the Paxton impeachment trial, an operation to unseat an elected official. Now we are waiting… for the U.S. Congress to pass Omnibus bills to steal taxpayer dollars and finance illegal operations. Waiting… while illegal immigrants and human traffickers run to the border. Waiting… while the cards are stacked against them for a new hand to be dealt. Waiting… for a remedy to the failure to conduct legitimate elections in the United States. It is time for Americans to stand together – as one and NEVER give up!
Hey President Trump and AG Paxton, have you got an ace up your sleeve?
